E1-E2 (Investor & Job Creator Visas)
Washington, D.C. Investor Visa Attorney
It is no surprise that the U.S. puts out a welcome mat for foreign visitors who have the potential to create jobs and provide a positive spark to the U.S. economy.
The E1 and E2 are nonimmigrant visas. The E1 is known as the treaty trader visa — for international traders from countries having trade treaties with the U.S. The E2 is known as the treaty investor visa. It is offered to those coming to this country to operate a business, and it includes visas for key personnel.

Foreign investors who are issued the investor visa are also eligible for an employment-based green card. Foreign investors may apply for permanent residence or a green card. About 10,000 immigrant visas are issued every year to foreign investors with an approved Form I-526.

The Eb5 may be thought of as the job creator’s and investor’s visa. It is specifically offered to immigrant investors who wish to be considered for permanent resident status upon investing $1 million here (or $500,000 in high unemployment areas).
Applications for an investor visa must be made on Form I-526 — Immigrant Petition by Alien Entrepreneur. Applicants must apply on their own behalf, and they must show that:
- They have already invested or are in the process of investing in a new or struggling U.S. company.
- The company invested in will create (or preserve) at least 10 full-time positions for American employees.
- The capital investment is at least $1 million in value ($500,000 in an area of significant unemployment).
The word “capital” does not necessarily mean cash. It may include material such as equipment, inventory, tangible property, cash equivalents and indebtedness secured by assets owned solely by the investor.
